建设项目抗震设防行政审批制度改革研究

近年来,许多地方政府为加快经济发展盲目追求行政审批时间的缩短,导致建设项目抗震设防行政审批被严重忽视。汶川地震造成大量房屋倒塌的事实表明有必要加强建设项目抗震设防审批工作。2003年以来,我国基本建设管理程序发生了重大变化,客观上要求改革现行建设项目抗震设防行政审批制度。文中分析了我国建设项目抗震设防行政审批制度的现状及其缺陷,并根据最新基本建设管理程序和新修订的《防震减灾法》,就这一改革提出了若干立法建议。

In recent years, many local governments seek to shorten the situation has made time of administrative examination blindly in order to speed up the development of economy, the administrative examination of the earthquake fortificatcon of the building project is neglected gravely. Wenchuan earthquake made a lot of houses fall down, the fact manifests that we must reinforce administrative examination of the earthquake fortification of the building project. Since 2003, the management procedure of capital construction in our country has been changed largely, the fact requires us to reform the current administrative examination regulations of earthquake fortification of the building project. The paper analyzes the current situation of the administrative examination regulations and their defects. On the basis, according to newest management regulation procedure of capital construction and the newest Earthquake Prevention and Disaster Mitigation Law, some legislation suggestions about the reform are put forward.
