Criminal Policy of Temper Justice with Mercy Should be Carried Out in Solving Criminal Cases of Petition Involving the Law and Prosecution

新《信访条例》规定:信访人包括公民、法人或者其他组织。接待信访的机关主要是各级人民政府、县级以上人民政府工作部门,信访事项主要是与行政机关行使管理职权相关的事项。因此,涉法涉诉信访工作是维护群众合法权益、实现社会公平与正义、化解人民内部矛盾的一项重要的基础性工作。涉法涉诉信访案件是当前信访工作的一项重要内容,其中刑事案件占有相当比例。认真贯彻宽严相济刑事政策,妥善处理涉法涉诉信访刑事案件,有助于在全社会普遍形成政府依法行政、司法机关依法办案的良好氛围,牢固树立党和政府在人民群众中的威信,减少社会对立面,促进社会稳定,更好地构建社会主义和谐社会。

The work of handling the letters from and protecting the masses＂ legal rights and interests, calls by the people is important and essential work in realizing social justice and resolving the contradictions among the people. Cases of letters and calls involving the law and prosecution are important contents of the present work of letters and calls, among which the amount of the criminal cases comes up to a large proportion. Implementing the criminal policy of temper justice with mercy, handling properly the criminal cases of letters and calls involving the law and prosecution will help to establish a better atmosphere that the governments administrate by law and the judicial departments handle cases in conformity with the legal provisions. Only in this way can we decrease our social antithesis, promote social stability and build up socialist harmonious society.
