摘要
欧盟指令已实施10年，但并没有如当初设想的那样，促进欧洲数据库产业快速发展。文章揭示了“特殊权利”保护存在的一些问题以及它对欧洲数据库产业的影响，为完善欧盟数据库保护指令提出了一些修改意见，并引发了对我国数据库保护的启示。
Abstract： The EU ＂Database Protection Directive＂ has been implemented for 10 years, but not as expected to promote the development of the European database industry rapidly. This paper reveals the problems ofthe ＂suigeneris＂ rightprotection showing in pmctice and itsinfluence on European database industry,then holds that the provisions of Directive 96/9/EC must be improved, and gives several policies to amending, and then gives enlightenment for our country.
