间接受害人精神损害是精神损害赔偿制度的重要组成部分,也是近年来各国侵权法备受争论的热点问题。在我国司法实践中,作为间接受害人请求精神损害赔偿的案例屡见不鲜,但我国现行法律对此作出的规定仍存在缺陷,而对此缺陷理论界尚未总结出切实可行的解决办法,无形中为法官审理此类案件设置了障碍。

Spirit damage of the indirect victims is an important component ofthe spirit damage compensation system and has been the hot debating issue in the tort law in every country in recent years. From the judicial practice in China, the cases about spirit damage compensation of the indirect victim are not uncommon, but China＇s existing laws still have shortcomings and deficiencies and theoretical circles have not a practical solution, which offers an obstacle for judges to hear such cases.
