The Validity Inferring of Real Estate Registration

不动产物权经登记具有权利正确性推定的效力,这既是不动产登记公示公信力的逻辑结果,也是保护第三人权利、维护交易秩序的要求。我国《物权法》的规定体现了该规则。从权利正确性推定的意义出发,对我国物权法中的权利正确性推定规则及相关制度的意义、适用范围以及权利救济等进行了分析、评价。

Registration of real estate has effect of validity inferring. This is not only the effect of registration of real estate, but also the demands for protecting the fights of the third party and maintaining the trade order. Our Property Law regulates this principle. Based on the conception of validity inferring, this study makes an analysis and evaluation on the inferring rules, meaning, application field for the right validity in ＂Property Law＂.
