On Particularity and Universality of Human Rights

人权具有普适性的价值,它维护人之为人所具有的尊严。人权之所以具有普适性的价值是因为人权是一种道德权利、是一种反抗权利,并且享有人权的主体是具有普遍性的。这些正是人权具有普适性的根源所在。在实践过程中所形成的各种具体人权,由于历史、社会文化背景等等的不同会使其呈现出不同的形式,而具有特殊性。

The human fights have the universal value and safeguard people＇s dignity. The reason is that the human fights are moral right, right to revolt and the main body of the human rights has the universal value. These are the root in which the universal value lies. In the practice process, as a result of different historical background and social culture, the concrete human rights present different forms with respective particularity.
