Empirical Research on Judicial System:Misleadings,Methods and Technologies

目前司法实证研究存在理论与实践脱节的方向性误区,分别表现为纯叙事和理论过度,以三项实证调研为例,对司法实证研究的技术性误区进行讨论。为了走出误区,必须提升实证研究的技术与策略。

Emphasizing the importance of empirical research, this article points out the the disjunction between theory and practice, which is the misleading existing in current empirical research on judicial system. It's characterized by pure narration and excessive theorization. Then, taking three empirical researches as the examples, the author discusses the misleadings in technology of empirical research on judicial system. Finally, with the aim of overcoming these misleadings and improving research method and technology, this article introduces the common methods and steps of empirical survey and emphasizes the skills and strategies of empirical research.
