摘要
我国的《劳动法》、《劳动合同法》和《集体合同规定》构建了集体合同的基本制度框架,但集体合同的实施却存在法定程序没有得到严格遵守、内容空洞、续签滞后等问题。为此,需要加强工会的建设,以使工会能够更好地代表劳动者并敢于维护劳动者的利益,同时通过立法强制企业签订集体合同。
Labor Law, Law on Employment Contracts and Collective Contract Provisions of China constitute the system of collective contract, but there are some problems in the implement of collective contracts, such as violation of legal procedure, empty content, delaying to renew contract. Therefore, we need to strengthen the labor union, so that the labor union can representatives laborers . to safeguards the laborers' interests, at the same time, we shall force the enterprise to sign collective contract by legislation
