救灾捐赠财产是为救助灾区群众而无偿给付的财产,属于公益捐赠财产范畴。公益捐赠具有受益权与控制权分离、受益主体虚拟化等特点,因而有必要对其进行法律监管。在外部监管上,应建立统一的业务监督主体,结束"多重监管,监管缺位"现象,完善信息公开机制;在内部监管中,建议在公益基金会内部增设监事会,大力发展行业自律组织。

By analyzing its quality of legal action and features of property rights, the paper points out that public-good endowment is characterized by separation of beneficial interests from control power and virtualization of beneficial main body, so it must be legally supervized. In terms of external supervision,it suggests that the government found an unified business supervision mainbody to end multiple supervision and absence of supervision and perfect the mechanism of information disclosure. In terms of internal supervision, it suggests that a board of supervisors be established in the public foundation and vigorously develop self-regulatory bodies.
