论我国法院对《纽约公约》裁决的承认与执行

The Recognition and Enforcement of the Arbitral Award Manifested in the New York Convention by the Courts in China

对《纽约公约》裁决的承认与执行是以其合法性为前提的。充分认识和理解审查公约裁决的必要性和依据是我国法院准确适用《纽约公约》的条件。对公约裁决的合法性审查应依据公约的规定和我国国内法的规定,审查内容包括公约裁决、仲裁协议、拒绝承认和执行仲裁裁决的理由和证据,以及我国法院对裁定不予执行的预先报告制度。参考其他的国际立法和规范对我国的司法实践具有重要的借鉴作用。

The recognition and enforcement of an arbitral award manifested in the New York Convention shall be based on the legitimacy of the award. Fully acknowledge and understand the necessity and basis of the legitimate review of such an award is the condition for the courts to apply the Convention correctly in China. The legitimate review of the award shall be in accordance with the Convention and the regulations in China. The review shall include the award manifested in the Convention, arbitral agreement, causes and proofs of rejection for the recognition and enforcement of an award, and the advanced report for the rejection of an award in China. It is also important for the judicial practice in China to consider other international legislation and conventions.
