目前我国小产权房的屡禁不止无疑是现行土地制度下各利益主体进行博弈的必然结果。首先分析围绕小产权房的利益之争,剖析《物权法》的相关规定,试图在《物权法》框架内重塑围绕小产权房的利益分配机制,将小产权房合法化并纳入我国现行住宅管理体制。
