摘要
尽管现有法律政策禁止小产权房入市流转,但在商品房价不断上涨的背景下,小产权房不仅未在政策严令禁止下退出房地产市场,反有愈演愈烈的趋势。但由于小产权房缺乏法律保护,未进行产权登记,与小产权房买卖相关的纠纷也开始凸显,各级法院通常判定小产权房买卖合同无效。不过从法理上讲,小产权房的违法性并不表示小产权买卖协议的无效,从长远看,应当逐步承认小产权房的合法性,允许其自由流转。
Although the law and policies prohibit informal house property from entering the real estate market, the legal disputes about informal house properties are increasing continuously. In this essay, it is not held that the concerning contract is null and void in the view of jurisprudence because the informal house property is not protected by law. Moreover, the transition of the tilte of informal house property shall be legitmate in the future.
