Analysis of Commercial Credit and Property Right Relationship:Centering on Ownership System

商事信用是人类在商事交易过程中的合作关系,其形成和扩展的主要障碍来自于交易者之间信息的不对称。商事信用与财产权之间存在着复杂的相互性,一方面,财产权作为克服信息不对称的制度工具,是商事信用的基础;另一方面,商事交易中客观的信用需求也推动着财产权制度的变化。所有权作为财产权制度的核心,其不同历史形态与社会的商事信用状况紧密相关,从财产法历史来看,个人所有权制度的产生也是适应商事交易中信用需求的过程。

The commercial credit is a cooperation relationship in the process of commercial dealings. The major obstacles in its formulation and expansion come from the asymmetry of message between the dealers. There exists complicated reciprocity between the commercial credit and the property right. On the one hand, the property right, as the regulation tool employed to overcome the message asymmetry, is the foundation of the commercial credit. On the other hand, the objective credit demand in the process of commercial dealings propels the transformation in the system of property right. Different historical forms of the ownership right, as the core of the property right system, are relevant to the situations of the social commercial credit. From the perspective of the history of the property law, the rise of the individual property system is its process of being adapted to the credit demand of commercial dealings.
