精神损害赔偿是民法的重要制度之一。对于著作侵权是否可以适用精神损害赔偿,近现代大陆法系国家在立法上持肯定的态度,而我国立法尚属空白。为此,法学界应该探讨著作侵权适用精神损害赔偿的理论基础和归责原则、适用范围、赔偿标准等问题,以期完善我国立法。

The spirit damage compensation is one of the important Civil Law systems. The legislation of the Continent Law System in the recent and modem countries persist in the spirit damage compensation for the infringement of the copyright, but this has not been stipulated in our country. So, in Civil Law field, we should explore the basic theories, the principle of affixing the responsibility, the applicable scope and the standard of the spirit damage compensation for the infringement of the copyright in order to perfect our legislation.
