Water Conflict Solution Pattern and Structure

水冲突的实质是水权冲突,水权的界定方式和程度以及制度的调适性是解决水冲突问题的关键。水冲突治理的制度安排存在政府主导、市场主导、社会主导三种基本模式,选择何种治理模式既受到制度本身的影响,也同样受到制度运行的宏观环境影响。改革政府职能与机构设置、完善水权结构、扶持社群管水自治组织发展、建立水冲突多元治理协商机制将有利于促进结构合理、运行高效的水冲突多中心治理结构的形成。

The focus of the water conflict is the water rights. The definition of the water rights and the adaptability are the two key problems in solving the water disputes. The solutions for the water conflicts have three basic patterns, including the government-orien- ted, market- oriented and public-oriented patterns. The selection of the patterns depends on the rules itself and also the macro backgrounds where it will run on. For the formation of the multi-central structure of the rational and effective water conflicts solution, it will be favorable to reform the function and structure of the government, improve the structure of the water rights and support the autonomous water management within the community
