农村土地承包经营权制度的立法概况、制度绩效与政策建议

Legislative Situation,Performance and Policy Suggestion of Rural Land Contract Management Right System in China

为了进一步加强农村土地承包经营权制度建设,笔者从农村土地承包经营权的立法概况的回顾出发,分析了国家近年来农村土地承包经营权法律制度的有关规定及制度绩效。认为,农村土地承包权制度改革需要侧重土地权利行使和保护角度,需要建构完善农村土地承包经营权的物权性质等目标模式,并对农村土地承包经营权制度提出了相应的政策建议。

The paper considers that reform of rural land contract right system needs to focus on the exercise and protection of land right and to establish the target model of perfect rural land contract management right with the property character by reviewing legislative situation of rural land contract management right and analyzing pertinent regulations and its performance in law system of rural land contract management right to further enhance construction of rural land contract management system, and puts forward the relative policy suggestions for perfecting rural land contract management system.
