大坝和溢洪道工程合同管理的特点

水电工程合同管理复杂而责任重大，因而日益受到人们的关注。虽然合同文件也日趋规范和完善，但是为了减少管理失误，借鉴类似工程的合同管理经验是非常必要的。天生桥一级水电站大坝和溢洪道工程合同，是参照ＦＩＤＩＣ合同条款编制的国际工程合同，它既有责任风险和管理程序明确的优点，又有引进先进技术人才和先进施工设备的优势，但也存在授标推迟引起设计和施工条件变更导致索赔等复杂情况。这里介绍了该合同的管理概况，并对这类工程合同有待解决的问题及完善合同管理提出了建议。

The contract management of the hydropower project is complicated and with heavy responsibilty, and thus, the particular attention is increasingly paid to it. The contract documents are becoming more standardized and perfect, but, in order to reduce faults in the contract management, it is very necessary to make reference to the contract management experience of similar projects. The constructional contract of dam and spillway works for Tianshengqiao No.1 Hydropower Station, formulated in light of FIDIC contract conditions, is an international engineering contract. It has advantages of definite responsibility risk and management procedure, and superiority of introducing qualified technical personnel and advanced constructional equipments. However, in the contract work there also exist some complicated situations such as claim indemnity due to changes of design and construction conditions caused by delayed bid awarding, etc.. In this paper, survey of this contract management is presented, and some suggestions are put forward in the light of problems to be solved in this sort of engineering contract and perfecting the contract management.
