请愿权视角下的信访制度

On the Letter-and Call System under the View of Petition Right

信访权的理论本质就是请愿权,信访制度的核心内容则是为了保障公民请愿权,以实现权利救济和参与国事的制度目的。从请愿权保障角度看,我国信访制度存在一定缺陷,须从三个方面重构信访制度:信访观念的更新;法律规定的完善;改革信访机构。

The theoretic essence of the right of letter-and-call is that of the petition. The kennel of letter-and-call system is to protect citizen＇s right of petition to realize the purpose of right relieving and the system of participation of state affairs. From the viewpoint of protecting petition right, there have been certain flaws in China＇ s letter-and-call system which must be restructured from three aspects： the updating of letter-and-call view; the perfection of legal regulations; and the refonn of letter-and-call organs.
