从农民工权益保护的视角看《工会法》的完善

On the Improvement of Trade Union Act from the Perspective of Protecting Rural Migrants

农民工的权益保护问题一直都是社会关注的热点,但我国现有《工会法》无法适用于农民工,无法对维护农民工的权益起到应有的作用。而且,《工会法》本身存在一定的缺陷,如工会形式单一、经费来源渠道不合理等,在一定程度上阻碍了工会作用的发挥。因此,应该从加强工会的自主性和内部的民主性、改革工会经费来源渠道、改善基层工会组织形式等方面来对《工会法》进行完善,从而加强对农民工权益的保护。

How to protect the rights and benefits of rural migrants has long worried the sociologists and the society as a whole. The Trade Union Act failed to deliver its promise owing to its defects such as the singleness of the union formation and the illegal channels to raise funds, which in turn harm the unions. This paper focuses on three ways to make amendments and better protect the vulnerable group. The Union should enjoy more autonomy and democracy, raise funds in multiple rather than single ways and reshape the grass-root union.
