高丽律对唐律变形之原因探析——以“华化”与“土俗”之关系为视角

On the Reasons for Deformation of Tang Code by Koryo Code——From the Perspective of the Relationship Between "Chinesezation" and "Local Customs"

法律的移植主要并不是一个法律或技术问题,而是一个综合性的社会系统工程,要受到移入国社会、政治、传统、风习等多种因素的影响。这些具体的国情,在高丽,被作为既得利益阶层的贵族集团不加区分地一概称之为"土风"、"土俗",成为其裹挟传统文化,以抵制中国制度的借口,从而形成了"华化"与"土俗"之间的冲突。在这种背景之下,高丽对唐律的移植就不能不扭曲变形。

The law transplantation is not only a legal or technical issue, but a comprehensive social systematic project. It is influenced by many factors social, political, traditional, habitual and so on. Such factors were called ＂local habits and customs＂ by the aristocrats in Koryo to resist the transplantation of the Chinese system and defend their vested interests. Hence the conflict between the ＂Chinesezation＂ and the ＂local habits and cus- toms＂ was triggered. The Tang code was distorted in the course of the law transplantation in the Koryo dynasty.
