中安油气资源合作国际法保障研究

Preliminary Study on the International Legal Protection of Sino-Angola Oil-Gas Resources Cooperation

油气资源安全与否不仅影响国家的经济持续发展,而且关系到国家的政治军事安全。中国是油气资源消费大国,急需从油气资源生产大国进口油气资源。安哥拉是油气资源生产大国,急需通过油气出口获取战后重建资金。正是在这种背景下,为满足各自战略需求并推动双方共同发展,中国与安哥拉开展了双边油气资源合作。在中安油气资源合作中,由国际条约、国际习惯、一般法律原则、司法判例、公法学家学说以及国际组织决议所构成的国际法,虽然起到了保驾护航的作用,但是现行相关国际法既不完备又不协调,严重地缺乏有效性,且急需弥补规制空白。基于此,中国与有关国家应逐步缔结与完善中安油气资源合作所涉多边与双边条约,提高中安油气资源合作所涉国际法的有效性。

For building a harmonious society, whether oil-gas resource is secure or not not only affects national economic sustainable development, but also influences national political and military security. China is a big power of oil-gas resources consumption, which is in urgent need of import- ing oil-gas resources from big powers of oil-gas resources production. Angola is a big power of oil-gas resources production, which is in urgent need of gaining postwar resettlement fund by export- ing oil-gas resources. Just against this background, in order to meet the strategic requirements and promote joint development, China and Angola have developed bilateral oil-gas resources cooperation. In the course of Sino-Angola oil-gas resources cooperation, international laws which consists of inter- national treaties, international customs, general principles of law, judicial cases, teachings of publicists and resolutions of international organizations have played an important role in the protection of the cooperation, but existing international laws fail to be complete or harmonize, lack validity badly and need urgently the filling of the void in the regulation. Therefore, relevant countries and China should enhance mutual trust and expand common interests under the guidance of the spirits of mutual re- spect, progressiveness, openness and pragmatism, so as to gradually improve the international legal protection of Sino-Angula oil-gas resources cooperation. During the course of establishing and im- proving the international legal protection of Sino-Angola oil-gas resources cooperation, relevant coun- tries should follow the guiding ideology of sustainable development concept and new energy security concept, observe the basic principles of economic sovereignty, fairness and mutual benefit, coopera- tion and development, internal and external coordination and public participation, and conclude and perfect bilateral and multilateral treaties relating to Sino-Angola oil-gas resources cooperation, in- crease the validity of the international laws relating to Sino-Angola oil-gas resources cooperation.
