摘要
在英国普通法上,父母的权利义务是不能让与的,所以英国在1926年前并没有现代意义上的收养制度,只是到了社会飞速发展变化的20世纪,英国才适应社会变化建立了收养制度,并飞速变革,在适应社会变革、保护被收养人权益以及严格监督收养过程等方面积累了成功的经验。汶川地震后,完善我国收养制度成为学界研究的重要课题,英国建立收养制度的成功经验无疑可为我们提供有益的启示。
In common law, rights and obligations of parents could not be relinquoshed to others, so before the 1926, there were no adoption system in the modem sense in England. However, with the rapid development of society, England established the adoption system in 20^th century. In the course of reth and vibrant practice, the British have accumulated a wealth of valuable experience, such as the protection of the adoption process, etc. How to perfect our adoption system is becoming an important subject, ofter wen-ehuan earth quake in the a cademit community of China, it is certain that the valuable experience of England will help us to improve our adoption system.
