正当防卫若干问题探析

正当防卫是我国刑法规定的一项重要制度,也是法律赋予公民的一项重要权利。在1997年修订的刑法中,对涉及正当防卫的一些问题进行了补充、修改和完善,但是,在近几年的司法理论及实践中,对正当防卫成立的条件、正当防卫与防卫过当的关系等问题仍然存在很多的争论。本文试就正当防卫的含义、构成要素以及与防卫过当的关系阐述一些自己的理解和认识。
