A Study on the Reform of International Financial Legal System Under the Background of Globalization

金融全球化一方面推动了世界经济和国际金融的发展,另一方面也使危机的传导更为迅速,范围更为广泛。美国次贷危机的爆发及其对全球的深刻影响,不仅为各国金融监管法制的改革提供了教训,更是对当今国际金融监管法制和国际金融秩序提出的挑战。针对当下国际金融无序的状态以及各国金融监管法制的不协调,借各国谋求建立国际金融新秩序的历史契机,探求国际金融监管法制改革的基本路径,以期找到符合我国利益的国际金融新秩序的构建体系。

Financial Globalization, on the one hand, has promoted the development of the world＇s economy and international finance,and on the other hand,it has sped up the spread of the crisis. The explosion of the Subprime Mortgage Loans Crisis originated from the USA has exerted a great impact on the whole world. It not only has provided the financial supervision in many countries with the lessons, but also has posed challenges for the present legal system of the international financial supervision and order. Based on present international financial disorder and incoordination of financial supervising legal system of different countries, we would he in pursuit of basic ways to reform the current international financial supervising legal system by taking advantage of establishing international new financial order so as to find out the construction system of international new financial order in accordance with our country＇s interests.
