On the Polluter Pays Principle

1972年经济合作和发展组织提出了污染者负担原则。越来越多的国际和国内立法采用该原则。该原则的内涵仍处于不断变动和发展之中。该原则同时具备多种功能,有利于实现环境正义。该原则不会扭曲国际贸易,亦不会构成对发展中国家接受经济援助的制度障碍。

Organization for Economic Cooperation and Development （OECD） proposed the polluter pays principle in 1972. More and more international legislations and domestic legislations take this principle. The connotation of this principle is still in the process of changing and developing. Meanwhile this principle has many functions and it is good to the realization of environ- mental justice. This principle will not distort the international trade, neither will it be the system barrier to developing countries to get the economic assistance.
