诚信政府与信息公开

Government Honesty and Information Disclosure

政府诚信是法治政府的必然要求。政府诚信要求政府保持政策的连续性,遵循信赖保护原则,正确处理公共利益与政府自身利益的关系,搞好公共利益与个人利益的平衡,忠实履行合同义务等。信息公开是诚信政府的基本要求和第一要义。没有信息公开,就没有政府和公众的真正沟通,政府与公众之间的真正信任也就无从建立。我国政府信息公开已经启动,但是还存在许多不足。建设和完善信息公开制度,需要更高层次的立法以及有效的司法审查、充分的利益表达机制和健全的民主法治环境。

Honesty is the necessary requirement for law-ruled government. It requires government to keep the continuity of policy, to follow the doctrine of trust protection, to deal properly with the relationship between public interest and government＇s interest, to keep balance between public interest and individual interest, to strictly effect a contract, etc. To establish honesty, information disclosure is the basic and most important of all measures. Without information disclosure, there would be no true communication, let along faith, between government and the public. Government information disclosure is already in effect in China, yet it has many defects. In order to perfect information disclosure system, government should inaugurate legislation by the National People＇s Congress, effective judicial review, full expression of varied interests and a perfect, democratic and law-ruled environment.
