摘要
担保物权善意取得的构造机理包括体系机理、理论机理、价值机理、要件机理和效力机理,善意取得制度是适应商品经济发展需要而产生的一项交易规则,它涉及民法所有权保护与交易安全的衡量。善意取得适用于动产所有权领域,但是否适用于担保物权领域,各国立法规定不一,学界亦存在不同见解。
Structural mechanism of security interests acquired in good faith includes system mechanism, value mechanism, elements mechanism and effectiveness mechanism. Acquired in good faith system is transaction rules made to adapt to the development of commodity economy , which involves civil law protection and transaction security measure. Scholars have different views on if acquired in good faith applying to security interests field.
