劳动教养法律监督权的缺失与完善

劳动教养制度本身的缺陷、对劳动教养监督不力的现状以及更好保障被劳教人员合法权益的需要,这些原因决定了要加强劳动教养法律监督。目前我国宪法和法律尚没有关于劳动教养法律监督权的明确规定,劳动教养法律监督的开展主要依据《国务院关于劳动教养的补充规定》、《人民检察院劳教检察办法》等行政法规、司法业务性文件,因此,劳动教养法律监督权法律依据不足。劳动教养法律监督尚存在监督力度不够、对劳动教养的呈批、审批、复查、复议程序无法监督等一系列问题,需要予以完善。

The education-through-labor program has its deficiency in adequate inspection of the process and protection of the prisoners' rights.All these problems require the reinforcement of the inspection of the education-through-labor program.At present,the constitution and the laws in China do not have any specific regulations on this issue.The inspection of the education-through-labor program is usually based on the administrative laws and regulations such as 'the Added Regulations on the Education-through-labor Program by the State Council',and 'the Regulations on the Education-through-labor Program Inspection by the People's Procuratorate'.As a result,the inspection of the education-through-labor program is not legally adequate,and still needs improvement in many aspects including the application,processing,recheck,etc.
