摘要
西方法治文化是将民主理念实践化、操作化的重要保障。对法治文化可以进行多维度、多层面的讨论,本文试图揭橥西方法治文化价值的哲学观念内核。哲学是文化的内核,自然亦是法治文化的内核。法治文化的核心是法治,法治的内容是民主,民主是个人自由和正义价值的政治表达形式。个人自由与正义及其辩证统一构成法治文化的根本价值。法治文化及其价值发轫和实行于西方,有其哲学观念理据。这些哲学观念就是"界限意识"、有的本体论、原子论宇宙观、"爱洛斯"与"逻各斯"统一传统以及启蒙思维方式。
The western law culture is a crucial guarantee to practice and operate the democratic ideals.It can be explored in multiple dimensions and from diverse perspectives.This paper attempts to probe into the philosophical core concept of western law culture.Philosophy, being the core of culture, would naturally take the core position of law culture which is centered on legality and filled with democracy in content.Democracy is the political manifestation of individual freedom and justice.The fundamental value of law culture resides in the dialectical unity of individual freeedom and justice.Law culture and its value originates and is implemented in the west and has philosophical grounds.The philosophical concepts are'limits of awareness', being ontology, atomism of the Universe,'Eros'and'Logos', the uniform tradition and enlightening thinking patterns.
