“欧洲法治”与“人本”思想——兼议欧美法治与马克思主义回归

"Europe Ruled by Law" and "Human-oriented Thought"——On the Flaws of Rule of Law in Europe & the U.S.and the Return to Marxism

欧洲法治进程是与欧洲的人文主义和个性解放紧密相连的,但是对"人本"思想的狭隘理解和对"自由、民主与人权"的激进主张必然会阻碍欧盟法治进程和引发欧美法治瑕疵,促使人们不断反思并形成一股强劲的社会思潮,真正意识到马克思主义的正确性并最终重拾马克思主义。欧洲法治只有坚持马克思主义范畴中的"人本"思想,才能更有力地维护良好社会秩序,造福予人类。

Although the process for Europe ruled by law is closely related to European humanism and liberation of individuality, a narrow understanding of ＂human-oriented thought＂ and radical views on ＂liberty, democracy and human rights＂ undoubtedly hinders this process and brings about its flaws such as the abortion of Treaty Establishing a Constitution for Europe and recent financial crisis in Europe and the U. S. , and what not, which prompt people to reflect and form a strong ideological trend or enlightenment campaign in which people realize the validity of Maxism and return to it, though some of them hate the obstinate ＂ghost＂. Only if Europe ruled by law persevere in ＂human-oriented thought＂ in the field of Maxism, it will maintain social order better, and will bring benefits to human being. Starting from ＂human-oriented thought＂ in Europe ruled by law and its flaws, this article analyzes the necessity and importance of true return to Maxism.
