摘要
由于高等院校的法学教育对实践教学仍然不够重视,同时,作为我国法律执业资格获得途径的司法考试中欠缺对实践能力的考核,因此在已经具备了对实践能力进行考核的主观条件和客观条件的情况下,我国应当参照外国相应的成熟的制度,从体制设置、考试内容、考核主体及考核方式四个方面设置独立于学校的外部监督制度——法学教育实践能力认证制度。
The law eduction in colleges pays little attention to practical teaching, and at the same time, as the way to acquire law-executing certificate, the judicial examination lacks the test of practical ability. So under the objective and subjective condition of having the ability to test the practical ability, use the relative ripe system abroad as referrence, we should set up the practical ability authentication system of law education, which is independent from outward supervison system of colleges, from the four aspects: system setting up, exam content, exam body and exam methods.
