摘要
限制权利为确保权利实现所必需,克减是一种权利限制。克减应该有明确的目的性和必要性,一些基本权利在任何情况下都不能克减;克减的价值功能是权利限制的价值功能的体现,而不可克减的权利不仅在形式上是克减功能发挥的纠偏机制,在价值功能上则是克减价值功能的具体体现和升华。
Right limit is indispensable for realizing right and it should have reasonable limit to guarantee its function to operate well. Derogation is a right limit. Thus, derogation should meet its conditions and serve its purpose on the one hand, and it should not reach some fundamental rights under any circumstances on the other hand. While the function of derogation embodies the function of right limit, non-derogable rights are not Only a mechanism to limit derogation in form, but also the embodiment and sublimation of the function of derogation in function.
