论取水权的物权化

On the property righting of the right of using water

关于取水权是否为一种稳定的、既得的财产权,主要有两种观点。赞成者只考虑了对财产权合法预期的保护,认为取水权应当物权化,因而可以将其定性为准物权或用益物权。反对者只考虑了公共利益的有效实现,认为取水权不能物权化,因而将其定性为债权或者公法上的权利等。为合理平衡财产权合法预期的保护与公共利益的有效实现之间的矛盾,应根据水的用途将取水权区分为可以物权化和不宜物权化的取水权。应当根据水量的变化以及个案的实际情况,原则上对于必须无条件保护和城乡生活用水等必须优先保护的取水权,可以物权化,而对于其他用水,是否应当物权化,应随公共利益保护需要的程度而定。

Whether the fight of using water is a stable,vested property right, there are mainly two different viewpoints. Some scholars think it is a stable, vested property right, considering the protections of property rights; while others don＇ t, who care about public interests. To balance the protection of properly fight and public interest, we should diverse the right of using water. Aocording to ＇the change of quantity of water and the practice, on principle we should take the fight of using water unconditionally protected and the right of using water used for living to urban and rural residents as a property right, while the right of using water used for other aspects depends on the degree of protection of public interests.
