非诉讼纠纷解决机制意义上的瑶族石牌制度

The Shipai System Found in Yao Family in Gunagxi Autonomic Region From ADR Perspective

石牌制度是中国少数民族习惯法之一,主要存在于广西境内的瑶族,尤其以大瑶山石牌制度为代表。从解决民事纠纷的非诉讼程序角度上看,我们把石牌作为解决民事纠纷的实体法与诉讼法的一种结合体。同时,石牌制度也是瑶族民间的非诉讼纠纷解决机制。

Shipai System, which is taken as a customary law in Yao Family in China. It is found in the territory of the Yao Family in Guangxi Autonomic Region , especially in Dayaoshan Region . From the view of ADR, we can take the Shipai System as a combination of the substantive law and procedural law. The Shipai System can be seen as a civil ADR of Yao Family.
