Significance of Improving People Jury System to Judicial Independence

人民陪审员制度与审判独立之间的关系较少受到关注。完善人民陪审员制度有助于抵制行政权对审判权的干涉以及防止人情关系对审判权的影响。完善人民陪审员制度要求改革现行的审判委员会制度和案件审批制度,它可以起到强化裁判者个体独立的作用。此外,人民陪审员制度的完善还可以营造审判独立的司法文化氛围,有助于实现我国真正的审判独立。

So far there has been little discussion involving the relationship between people jury system and judicial independence. In practice, improvement of people jury system is helpful for avoiding administrative power intervention in jurisdiction and minimizing the influences of human relationship on jurisdiction. Accordingly, it is of necessity to reform the current judi- cial committee system and case examination and approval system with a view to highlighting judges＇ judicial independence. In addition, improving people jury system is of importance to developing independent judicial culture and to achieving real judicial independence.
