摘要
高校制定校规管理学生,应该受法律保留原则的约束。与西方国家相比,我国目前立法对法律保留原则涉及很少。高校因违反法律保留原则进行学生管理而频频被诉,对现行相关的法律进行完善,在现阶段是最为可行和有效的办法。
University＇ s regularity formulating on students＇ maintenance should be restricted with the legal reservation principles. Comparing with western countires, China＇ s current legislation seldom involving reserving principles. University＇ s frequent appealing in the court due to disobedience to legal reservation principles, therefore, improving the current relative law turned out the feasible and effective approach on the current phase .
