我国跨流域调水水权生态补偿的法律思考

Legal Conception of Water Right Ecological Compensation Mechanism of Inter-basin Water Transfer in China

我国跨流域调水的生态补偿,应将水权补偿作为其重要的组成部分,积极通过市场手段完善生态补偿机制。水权生态补偿的核心是水价构成,水权转让费中应该包括生态补偿的费用。围绕我国传统跨流域调水生态补偿机制的变革,法律法规以及相关配套措施的完善被提上了议事日程。本文从水权生态补偿的法律地位、水权生态补偿的原则、水权生态补偿的主体三个方面,提出了我国跨流域调水水权生态补偿的立法设想。

To carry out the ecological compensation of inter-basin water transfer in China, we should put the water right compensation as a vital part and actively improve the ecological compensation mechanism through the adoption of market-based instruments. The constitution of the water price is the core of water right compensation and the cost of ecological compensation should be included into the fee of water right transfer. Around the reformation of ecological compensation of inter-basin water transfer in China, relative laws and regulations and measures have been put on the agenda. From the legal status, principle and subject of water right ecological compensation, this paper puts forward a legislative conception about water right ecological compensation mechanism of inter-basin water transfer in China.
