摘要
《海域使用管理法》和《物权法》对海域使用权抵押权均未置明文,但海域使用权属于"法律、行政法规未禁止抵押的其他财产",可以设定抵押权。《物权法》上对海域使用权抵押权自何时设立未作规定,应当类推适用建设用地使用权抵押权和土地承包经营权抵押权设立的规定,海域使用权抵押权自登记之日起设立。现行海域使用权抵押权登记规则和实行规则应予完善。
Hypothec on the area usage right is not stipulated in Property Law. However, the area usage right belongs to other kinds be hypotheced by laws and administrative statutes'and therefor can Property Law when hypothec on the area usage right is created, Area Usage Administration Law and of property which are not forbidden to be hypotheced. It is not provided in and shall apply by analogy to the creation rules of hypothec on the building land usage right and hypothec on the land management right, ie, hypothec on the area usage right is not created until registration. Current rules on thr registration of hypothec on the area usage right shall be perfected.
