摘要
2008年3月31日发生的"东航返航事件"引起了社会各界的广泛关注,其中涉及的诸多法律问题也引发了人们的讨论。从劳动法的角度分析,该事件集中反映出国有航空公司与飞行员之间的劳资矛盾,其中重要的一点就是飞行员劳动合同涉及的服务期问题以及违反服务期所导致的违约金问题。以该事件为切入点审视现行法律关于服务期的规定会发现,相关立法未对服务期适用的劳动合同类型、合理期限的确定方式做出明确的规定,违约金的设置也有失周全。从应然的角度分析,法律应当规定服务期适用于无固定期限劳动合同,服务期的期限确定应以培训费与劳动者月工资的比例为基础,以此修正现行违约金规定的不适内容。同时应考虑适时建立飞行员"转会"制度,以实现高技术人才的合理流动。
The return event of China Eastern Air Holding Company which happened on March 31 st 2008 showed the industrial conflicts between the State -owned airlines and pilots, especially the service period arranged by the pilots employment contracts and penalty. The service period regulation does not set the related types of contracts and the way to determine proper period clearly. Thus the service period regulation ought to apply to the employment contracts with no fixed time, also the period should be based on the proportion of training expense divided by the wage per month. Meanwhile the pilots transfer system should be taken into account.
