试论城市房屋拆迁中政府职能的错位及其对策

近年来,在城市房屋拆迁中政府侵犯被拆迁人权益的现象屡见不鲜,其主要原因是政府未能找准其在城市房屋拆迁中应扮演的角色,因此,政府在城市房屋拆迁中的职能必须回归和到位。一要逐步取消城市房屋拆迁行政许可制度;二要取消政府的行政裁决权和强制拆迁权;三要政府认真做好城市房屋拆迁的指导、监督、管理、协调工作。

Power dislocation of local governments has often caused infringement of house owner＇s rights during urban house demolition in recent years in China. Ways to ensure governments＇ proper role are explored as follows： 1. it is necessary to gradually annul the administrative license for demolition; 2. administrative adjudication and forcible demolition must be banned; 3. local governments should carefully guide, supervise, manage and collaborate any urban house demolition.
