在城市化和农村建设领域,土地非农化过程中的权利设置和其流转是至关重要的环节,决定了土地资源转换中的公平和效率,对于维护社会公平正义和集约利用土地资源具有重大意义。土地非农化过程中,在交易各方权能和交易机制及土地保障机制方面,现行制度还存在着效率和公平上的缺憾,应通过完善产权设置和经营机制、推动交易机制的革新、加强后续保障措施、建立更中立和更完善的救济机制等措施加以完善。

In the urbanization and rural construction process,it is very important to properly handle the rights and distribution during non-agricultural utilization of land. It determines the social equity and productivity of land consolidation. However,for the sake of preserving social equity and efficiency,we need to consummate the setup of property rights and land operating mechanism and enhance the reform of trading system;moreover,we need to provide more complete assurance and establish a more neutral and more comprehensive relief mechanism.
