制度设计的理性——当前中国信访制度的一种审视

On Ration of Systematic Design——On the Survey on China's System of Letter Visits at Present

现行信访制度的主要功能在于权利救济和反官僚主义。但是,由于制度设计的理性不足,信访制度消解了司法制度的权威,同时自身也陷入了官僚化的泥潭。而这些导致了"信访洪峰"和"限制上访"的困境。因此,应理性地进行制度设计和改造,以保证信访制度与其他制度之间的和谐,以及信访制度本身内部的和谐。

The main function of present-day system of letter visits lies in both rights relief and Anti-Bureaucracy. However, the system of letter visits dispels power of judicial system and sinks itself in the quagmire of bureaucracy with the deficiency of ration of systematic design, which leads to the dilemma of the ＇ flood peak＇ of letter visits and ＇restraining appeal＇. Thus, the systematic design and modification should be rational to guarantee the harmony be- tween system of letter visits and other systems and inner harmony of system of letter visits itself.
