建立城乡统一的建设用地土地市场的土地法学研究

The Establishment of a Unified Urban and Rural Land for Construction of the Land Law of the Land Market Research

农村建设用地流转长期以来不规范,管理较为混乱,不仅使规划指标屡屡突破,而且正常的市场秩序也受到干扰。党的十七届三中全会通过的《中共中央关于推进农村改革发展若干重大问题的决定》为今后农村建设用地流转指明了方向。本文从土地法学的角度,分析了建立城乡统一的建设用地市场的法律基础,并探讨了为建立农村建设用地市场需进一步加强的法律及制度建设。

The construction land market of the rural circulates irregularly for a long time and the management of it is very chaos.Not only planning targets repeatedly break,but also is the normal market order interfered.The Third Plenary Session of the 'CPC Central Committee on rural reform and develop a number of important issues' directs the right direction for the future transfer of land for construction in rural areas specified in the right direction.From the perspective of the Land Law,an analysis of the establishment of a unified urban and rural land for construction of the legal basis for the market and to explore the construction of rural land for the establishment of the market need to further strengthen the legal system and building.
