发达国家循环经济的立法进展及其对我国的借鉴意义

Legislative Process of Circular Economy in Developed Countries and Its Reference Value for China

德国、日本、美国以及其他欧美发达国家在循环经济立法方面所取得的进展,为我国循环经济立法提供了宝贵经验。目前我国循环经济基本法虽已出台,但循环经济法规体系尚不完善,需要通过清理和修订已有的法律法规、启动缺位法律的立法工作、加快地方性立法进程、完善配套的制度建设等措施加以改进,以建立起有中国特色的循环经济发展模式。

Great progress in the legislation of circular economy has been made in Germany, Japan, the United States of America and other developed European countries, which has provided a valuable point of reference for China. Currently, the basic law of circular economy has been enacted in China, but the legal system of circular economy is far from perfect. In attempts to establish a development mode of circular economy with Chinese characteristics, measures need to be taken to sort out and modify the existing laws and regulations, to start making law of absence, to speed up the local legislative process, and to improve necessary institutional build-up.
