摘要
行政迟缓的显著特征是职责的履行逾越了时限,而这个时限不是明确规定的。判断是否构成行政迟缓需要依据处理类似案件所需的时间、行政主体的主客观因素、原告的损失以及被告提供的理由等因素加以确定。而且,在审查诉称构成行政迟缓的案件中,法院并不是万能的,必须尊重行政的专业特长和立法机关的立法优势。我国告诉的有关行政迟缓的案件在超时方面比较明显,法院的推理过程显得单薄。对于涉及行政迟缓案件的受理,可以参照美国穷尽救济原则和成熟原则的要求对我国的相关制度进行设计。认定行政迟缓的路径不应单一化,需要转换路径。行政迟缓问题的核心是决定案件处理时间及先后顺序的裁量权是否滥用,在此基础上,法院可以提供相应的救济。
The significant feature of administrative delay is beyond the time limited, which is not clearly defined. Whether there is administrative delay lies in these factors, such as the time to deal withsimilar cases, the objective and subjective factors of administrative subject, the plaintiff's loss, the reasons the defendant provides, etc. Moreover, in reviewing such cases, the court isnt omnipotent, and it must respect the administrative organ's expertise and advantages of the legislature. Cases concerning administrative delay are obviously overtime in our country, and the court's reasoning appears weak. We can draw lessons from the United States in our system design in accordance with its principles of exhaustion and maturity. There are many ways to confirm administrative delay , including angle conversion. The core of administrative delay is whether there is the abuse of discretion in determining the sequence of cases and the time they take. Courts may provide relevant relief on that basis.
