摘要
我国渔业在迅速发展的同时伴随着立法和管理框架的不断完善。本文对我国立法结构层次和渔业行政管理体制进行了简要分析,在此基础上回顾了我国渔业管理的发展历程,进而指出制度不完善、渔民法律观念淡薄、对渔船的监控不力是渔业管理失灵的主要原因。论文最后部分提出了我国渔业立法和管理框架建设的建议。
With the rapid development of the fisheries industry, fisheries legislation and management framework has been gradually improved in China. Author has briefly analyzed the legislation structure and administration system in China. Based on review of fisheries management development in China, author has pointed out three major reasons on failure of fisheries management, which are institutional defect, poor legal awareness and inadequate fisher monitoring. Finally, author has proposed some suggestions fisheries legislation and management framework in China.
