摘要
本文从创作与法律两个方面提出了"作者"问题,并由此上升为相关的作品权益问题,进而追溯了英国浪漫派尤其是华兹华斯的著作权观点对版权法形成的关键作用;本文的目的是激活不同学科对著作权问题本质的反思,因为这一问题愈来愈具有跨文化的当下性;作者认为,回顾与探讨当代版权法的浪漫主义价值观,乃是打通文学理论与法律理论对话的基础。
This paper raises the question of 'author' and the related one of the right of literary creation from both aspects of creation and law,and traces the crucial role played by the English Romantics,especially Wordsworth,in the formation of copyright laws.It aims to set off reflections on the essence of authorship in various disciplines,for the issue has an increasingly interdisplinary currency.By reflecting on and exploring the Romantic values in contemporary copyright laws,we can start the conversation between literary theories and legal theories.
