摘要
当前我国城市房屋拆迁补偿中存在着诸公共利益与商业利益的严重错位、补偿方式、范围与标准不合理以及补偿程序不健全等问题。对此,必须正确界定"公共利益"范围、实现补偿方式、范围与标准的合理化、明确政府的角色与定位和加强司法救济,以进一步完善我国城市房屋拆迁补偿制度。
Compensation for Urban house demolition is necessary. There are various problems in Chinese urban house demolition compensation, such as dislocation of public interests and commercial interests, improper means of compensation, unreasonable scope, standards and compensation procedures and so on. It is necessary to redefine the term ＂public interests＂ properly, rationalize the compensation methods, scope and standards,position clearly the Government＇s role and strengthen judicial relief, so as to further improve Chinese urban house demolition compensation system.
