Property and Interest Guarantee and Their Regularities in Farmland Leasehold Transference

研究目的:探讨土地承包经营权流转可能产生的问题,提出防范对策。研究方法:理论分析方法。研究结果:土地承包经营权流转中权益的保障和规范是主要问题,其中权益的保障体现在实体性、价值性和流动性三个方面;提出完善土地承包经营权管理和服务体系及其配套措施的具体建议。研究结论:应该重视和研究土地承包经营权流转制度变迁带来的新问题。

The purpose of this paper is to discuss the existing problems of farmland leasehold transfers, and try to provide some countermeasures. Theoretical analysis is employed in the study. It finds that the property and interest guarantee, and their regularities in land leasehold transfer are currently the striking problems. The problem of interest guarantee lies in its substantiality,value and mobility. Thus, the paper provides some detailed recommendations for land leasehold management and service system, as well as concrete measures. It is concluded that it is time to pay more attention to the new issues incurred by the revision of land leasehold policies.
