论我国土壤污染防治法制订的必要性

Talking about the Necessity of Formulating Law of Preventing and Controlling Soil Contamination in China

土壤具有重要的生态、经济及战略意义,当前我国的耕地、工矿区、城市都存在较严重的土壤污染问题,而现行的零星法律规范散见于各法律法规中,有诸多缺陷,不足以对土壤污染防治实施有效规制。鉴于一些工业发达国家及我国台湾地区制定了统一的专门性土壤污染防治法,且产生了良好的实践效果,十一届全国人大应将《土壤污染防治法》列入本届人大的立法规划,建立完善的土壤污染防治体系。

The soil has the important sense of ecology, economy and srategic. In the current, our farming, the industry and mining areas and the city have a serious soil contamination. But so far ,there are so many flaws in various laws and regulations that we can＇t prevent and control the soil contamination in the right way. In view of the fact that some developed industry countries and Taiwan Region have all formulated unified and specialized laws of preventing and controlling soil contamination and they all receive good practice results, the 11th of National People＇s Congress should take the law of preventing and controlling soil contamination into the legislation plan so as to establish the perfect system of preventing and controlling soil contamination.
